TJS Family History: Terms and Conditions

  2. Welcome to TJS Family History. The following outlines the terms and conditions we will follow when engaging in work for our client base.

  3. Intellectual Property Rights
  4. Unless otherwise stated, TJS Family History retain ownership of the intellectual property rights for all material on TJS Family History website. All intellectual property rights are reserved. You may access this from TJS Family History for your own personal use subjected to restrictions set in these terms and conditions. You must not:
    • Republish material from TJS Family History
    • Sell, rent, or sub-license material from TJS Family History
    • Reproduce, duplicate, or copy material from TJS Family History
    • Redistribute content from TJS Family History


  5. Terms of Engagement
  6. Before undertaking any work for a Client, we will confirm our understanding as discussed during our initial consultation and ensure agreement of this understanding with the Client before commencing the research. Expectations will be communicated by both parties during the initial consultation. The Client agrees to provide accurate and lawful information. TJS Family History is not responsible for omissions or errors arising from incorrect or incomplete information provided by the Client. All research will be conducted based on the information received from the Client. It is the responsibility of the Client to ensure that that information is correct and up to date. All findings will be reported to the Client at the end of our agreed research period. All documentation will be handed to the Client, in digital form on a USB or in hard copy, when available. All expected costs will be communicated to the Client during the initial consultation. Any further costs will be communicated prior to them being incurred. Time charged will include all research, travel, report writing and communication with the Client. If during the course of the research, it becomes clear that specific areas are outside my expertise, this will be communicated to the client and recommendations will be offered.

  7. Payment Terms
  8. All Clients are required to pay a deposit prior to work commencing. this is to show good faith and is charged at £50, or 10% of the overall fee, if working to a package rate, whichever is the greater. When engaged on an hourly basis, the chargeable rate will be £25 per hour, with a minimum of 2 hours charged. If engaged on a package rate, this will be outlined in the initial consultation. Payments are can be made through PayPal and also via Bank Transfer. Receipts can be provided if required for all payments.

  9. Research
  10. Genealogical research is not an exact science. Results are dependent on the accuracy of the information provided by the Client and the availability, quality, and legibility of surviving records. Research can be complex and time-consuming, and it may not always produce the results hoped for or answer all research questions. This will be explained during the initial consultation. Regardless of the outcome, payment for the time and work undertaken is still required.
    The term "Research" is defined by, and will refer to, Research in Archives or online using various databases.

  11. Report Writting
  12. A Report of the research undertaken, together with any findings, will be provided to the Client upon completion of the work. The report will include a breakdown of time spent on research in archives, research online, and report writing. Report writing is included within the time purchased and is therefore a chargeable service. The final report remains the property of TJS Family History until full payment has been received. Once paid in full, the report is for the Client’s personal use only and must not be reproduced, published, or shared without the prior written consent of TJS Family History.

  13. Accreditation & Reassurance
  14. I am a qualified Genealogist through Strathclyde University, and Associate Member of AGRA, (Association of Genealogists & Researchers in Archives). As an Associate, I am bound by their Code of Practice and Ethics. You can view their code of ethics here.

    I am constantly improving and developing my knowledge and experience in Genealogy and Family History in order to provide a quality service to my Client base.

  15. Governing Law and Data Protection
  16. These terms and conditions are governed by and construed in accordance with UK law. All data is processed in compliance with the UK Data Protection Act and the UK GDPR. We will not share any personal information of living individuals without their consent, and we will only use personal information provided for the purpose of carrying out work as requested by the Client. Clients have the right to request access to, correction of, or deletion of their personal data in line with GDPR.

    Living individuals will not be investigated, and no contact details or personal information will be provided to the Client, without the prior written consent of those individuals.
